For the purpose of this paper I will be discussing the questions posed in the course syllabus by my professor: * Prosecutorial Misconduct   * Prosecutorial misconduct is best described as illegal acts utilized by a prosecutor to persuade a jury to wrongly convict an individual accused of a crime or securing a severe sentence that may not be justified towards the actual crime. Often times there are occurrences of individuals that are wrongfully convicted, many of these individuals are incarcerated for extended periods of time before their cases are even heard or brought before a jury. * Ineffective assistance by criminal counsel An attorney providing ineffective assistance can be considered as those occurrences when the service provided by an attorney to a defendant proves to be ineffective and in doing so, would be a violation of the Sixth Amendment of the Constitution. Ineffective assistance of counsel is defined in the Supreme Court’s ruling surrounding the landmark case of Strickland v. Washington (1984). In order for a defendant to prove ineffective assistance, the individual would first have to provide proof that demonstrates that his counsel’s performance was inefficient due to the attorney make a large number of errors. Secondly, the defendant must demonstrate that the attorney’s errors directly impacted the defendant’s case prejudicially. In this instance prejudice takes on the meaning of†¦.the trial would have resulted in a different outcome it not for the fact of the attorney’s errors resulting in the sentencing be affected. * Judicial misconduct Judicial misconduct refers to the judge’s conduct and the fact that they are constantly in the view of the public, so they are held to a higher standard in the area of respecting the individuals they interact with on a daily basis as well as all defendants that appear before them in court. * Real life stories My real life story on prosecutorial misconduct focuses on the case of Raymond Towler, who was convicted on the charge of rape of an eleven year old girl and completed 30 years of a sentenced life sentence trying to convince the courts of his innocence. Assistant District Attorney Bill Mason motto of â€Å"win no matter what† resulted in him eliciting testimony that he knew, or had been advised was in accurate. Mason interviewed a police detective who stated in court that Towler never denied raping the eleven year old; however, notes written by the detective himself during his investigation supported Towler’s claims to not having raped the child. In responding to Mason’s questions, a police officer provided testimony that Towler had some form of an indecent communication with the child prior to the rape. Yet police records indicated that it was Chris Towler, Raymond’s brother, who had communication (which was appropriate) with the child. Even with a variety of inconsistencies present, a misled jury still convicted Towler. The mistake the prosecutor made was that he did not utilize sufficient evidence in the case or the fact that Towler wasn’t nowhere near the area or the fact that he never even came in contact with the child, physically or verbally. He also failed to utilize the statement taken by the officer concerning to it being Towler’s brother that was in the area where the act supposedly occurred and had the documented conversation with the child. Without these little pieces of evidence being presented Towler was sentence to life in prison and had spent 30 years incarcerated. How do you replace the time that individual lost? What form of immunity provides protection to the prosecutor pertaining to consequences of misconduct? By the guidelines set forth in the legal dictionary â€Å"Prosecutors are afforded totally immunity for any actions committed before a Grand Jury or a trial. However, while conducting the investigatory phase, only qualified immunity is granted to them. In the case of Kalina v. Fletcher, (1997), it was ruled by the United States Supreme Court that absolute immunity was not a right entitled to prosecutor in regards to his/her actions of allegedly submitting false statements of facts in an Affidavit supporting the application document for an arrest warrant. Consideration of policies regarding merited absolute immunity contains interest of both protection of the prosecutor of harassing litigation that would disrupt the required time or the attention allocated for official duties and the interest towards providing him/her the ability to utilize independent judgment pertaining to decisions on which suits to file and pursue in court. Another example of a real life story pertaining to judicial misconduct would be the case involving Samuel Kent, Mr. Kent served as a judge for over 18 years, but was now being sentenced to three years inside a federal prison for lying about inappropriate conduct towards his staff, of which two provided physic al evidence as to number of years they both endured various assaults by the judge who was for the most part intoxicated. The pattern of sexual misconduct directed at the judges co-workers along with constant violations of workplace intoxication are obvious wrongdoings committed by the judge. It is my opinion that performing elections would be better suited process for judicial selection due to its ability to allow the citizens to make their own choice as to who should represent them through the process of researching them first. While certainly recognizing these acts of misconducts occurring within our criminal justice system, how we propose deter criminal acts on the streets when it’s evident we can not deter it inside of our courts and legal system. Then when you factor in the occurrences of individuals being incarcerated and then being found innocent and having to be compensated through local and state funds that we other citizens are responsible for not to mention the lost of time these individuals lose from their life, friends, and family; which honestly begs the question how could any amount of money replace this time. In my opinion, we as a society really need to make ourselves more aware to the fact that these issues require addressing in our criminal justice system. We really need the accessibility of additional resources required to fill more jobs with truly qualified individuals versus our penchant for sacrificing ourselves to individuals with recognizable names or higher government officials who claim to have or best interest at heart when certain decisions they make appear to be the complete opposite. Change occurs frequently and rapidly in the workplace. Change in business has become the norm and businesses need to evolve to keep up with the demands of the modern world. Most of the people regard change as intimidating. It is often natural. It has great significance in business thus change does bring good for the business. So why does change happens? There are two main reasons for the changes in a business environment: 1. Reactive change- pressure to change (PEST) – POLITICAL – it is when government changes policies, regulation, etc which business needs to adapt to stay within the new laws; international changes or conflicts force business to change; legislations whether they domestic or international or future; – ECONOMIC- it is when domestic or international competitor’s behavior, trends or tax and interest rates change which forces the changes in the business; – SOCIAL- it often happens when customers demands, buying preferences change, as well as when events, media views or advertising makes business Identify the main reasons for reviewing working methods, products and / or services in a business environment. Once your business is established and running well, you may be inclined to let things continue to run as they are. However, it’s actually time to plan again. After the crucial early stages, you should regularly review your progress, identify how you can make the most of the market position you’ve established and decide where to take your business next. You will need to revisit and update your business plan with your new strategy in mind and make sure you introduce the developments you’ve noted. Everyone is different that is way some people may find change as something stimulating and exciting making them perform better others may find it very hard and difficult to adapt. This is way this type of people need extra time and support to get use to change happening in the work place. Theory suggests that these people will go through what is called: Change Performance Curve: Shock – The initial reaction can sometimes be shock, this will automatically reduce the individuals performance as they will fear the unknown. Denial – This is when the individual will stay focused in the past and the ‘way things used to be done’. The fear of the ‘new way’ may cause the individual to continue to complete their tasks the ‘old way’. Anger – Once the initial feelings have been dealt with denial slowly turns to anger. Depression – Once the individual finally realises that the change is going to happen, they enter the depression stage The individual accepts that the change is happening. Integration But there are different types of support that can help people during change. These include: †¢ Effective planning ( plan the change an inform people of the change) †¢ Participation ( let people be involved in the process) †¢ Training or retraining ( provide training so stuff if prepared for new tasks) †¢ Encouragement or other supportive behaviours ( provide support by encouraging not criticizing- good communication can really help people accept a change more quickly. Counselling or coaching b) Explain the benefits of working with others. As said above good communication can really help people accept a change more quickly. Working as a team can really help to adapt to change and helps people get through Change Performance Curve easier as they can help each other in dealing with new and more complex tasks. You will be able to help support your colleagues if they are finding something challenging and vice versa. It is important to remember that to support and work with colleagues effectively you will need to keep a positive outlook yourself. Understand how to respond to change in a business environment 1. In relation to your current business environment (or one that you are familiar with): a) Explain why you should respond positively to changes in working methods. When change occurs in a business it is important to see it as something positive. This will help to make the process a lot easier, even though the benefits may not be immediately obvious. If employees see change as a bad thing, they will soon become demotivated, which will affect The quality and efficiency of the business. While sometimes it may be difficult to accept change, employees need to be able to adapt to whatever they are presented with. Businesses need employees who have positive attitudes; they want people who say ‘I can do that’ not ‘I can’t do that’. A positive attitude can go a long way to help solve problems in difficult situations. b) Explain why you should respond positively to changes in products or services. Changes can be either expected or unexpected but nowadays change is a permanent phenomenon. I work in retail and I know that changes in this type of business is someting that cannot be forgotten or ignored. As an employee of one of the biggest beauty retailer in the UK I see almost everyday changes in the work place that take place to improve products and services we provide. I know it is very important to keep up with customers‘ demands and market innovations. It is very important to stay positive about this changes to make sure you do your best to help the business you work for improve and stay on top along other similar businesses. Analysis on my Favorite Poems Essay Dorothy Parker’s poem entitled â€Å"One Perfect Rose† is a simple verse that talks about the joy of the narrator. Despite of all the odds and confusion, she remained happy with the rose that she received. The narrator is not actually contented with what she has because she wants more than what she already received despite of its â€Å"perfection,† but she tried to be satisfied with it. The main theme of the poem is joy or happiness. Like many other woman, the narrator was very happy after receiving a very special and perfect flower just for her from the one she loved. The phrase â€Å"One perfect rose† was scattered all over the poem to justify the happiness of the narrator that happens in reality because we used to express our happiness by saying a certain thing often that delighted us. The author used irony or comparing two things with different identity or individuality such as rose and limousine also leaves and heart. Based on my interpretations, I have seen that the author wanted to show the distinction of the two terms as well as its similarity. In realism, a woman wants to enjoy herself riding a limousine after receiving a flower. From this, she feels that she is the most beautiful woman ever. On the other hand, the existence of metaphorical heart of the narrator’s man as it refers to the leaves shows irony because a leaf drops once it began to pale, which is different from a loving heart that became stronger and dignified even if it is the only one who loves. Those literary terms in the poem made me think of its sense in a deeper manner. Even if the author already gave all the details without making her readers think or imagine the emotion of the narrator, she used literary terms to make each stanza complex by showing ironies, metaphors, simile, and images or symbolisms that hides the true meaning of the poem. From here, I can say that the poem is nice and understandable that made its readers capable of reading the poem without any boundaries of uncertainties. My Papa’s Waltz by Theodore Roethke Theodore Roethke’s poem, entitled â€Å"My Papa’s Waltz† shows the life of a boy within the hands of his father. The author wanted to convey a deeper meaning in his poem. By way of reading it, I can see that it was not just a simple learning of dancing that made the narrator struggled into his father’s authority. From learning how to follow his father’s dance step signifies his pursuance of obeying his father as well as making his life the same his father’s life. The main theme of the poem is fear. The narrator was afraid to counter-attack his father from all its way of educating him but he could not do anything because even his mother could not talk or act against his father. Based on my interpretation, the author wrote this poem because he experienced the same pain and struggle of his narrator. Readers could feel each situation and waiting for the next occurrence that can happen. The poem has no resolution at all. This verse illustrates the entire situation without any act of resolving the conflict. The father is the only authority because both the child and the mother could not speak for their rights. From this, I can also say that the author justified a simple way of describing a woman and child abuse that happened within a family that many could not able to perceive. The author showed and discussed the life of a maid without happiness but always failure. The author used two different characters in the story to show the emotions of a maid by using her friend. The author utilized jargons or terms that usually used in African-American community. Through this, even if the author did not state the physical characteristics of the maid, it shows that it refers to the Blacks by way f acknowledging the usage of words and terms in the whole poem. The author putted different literary terms or symbolisms to justify his claim about the ruined maid. These lines showed that work of the maid was not just to clean a house or to take care of the children, but becoming like a farmer. Animals in captivity. It has been an issue since the first zoo was opened. Many people are for and against it. I think that there are many pros and cons to having them in captivity. The main issue in the world is how do you possibly make it as close to the animal’s natural environment in captivity. It is almost impossible. You can’t start building sea world all over the ocean and hope the animals show up. I live in Agoura hills, big for horse property. At my grandma’s we have three Arabian horses. The thing is that they are wild animals, and need to do what they do best, RUN. We have three acres of pasture they can run around and play and be horses. Now let me tell you, they love their treats. Animals love to learn. I see it in our horses every day. They are happy. They get kept clean, fed, ridden, and get treats. Wild horses live on hundred of thousands of acres. If you take one of those and train it they love it. They like being fed, cleaned, and get treats. Now a lot of people would say that is different than keeping a killer whale at sea world. In some ways it is and in some ways it isn’t. The whales at sea world are always happy and love attention that they receive. I watched a program on the discovery channel a while a go. It was about the marine animals that were in captivity. Those whales loved being trained and getting a reward of fish when they do something correct. Now look at the con of this situation. Is this anything close to what they would get in nature. No. They do not get the mass oceans to swim. They do not get the freedom to live. But in some ways it is better. The have some of the most amazing trainers, vets, and marine experts in the world on call 24/7. Now I am not saying that we should take ... ...est care and get sick or die (Keiko in Mexico) So you see their a lot of pros and cons. Another point people bring up is the mental stability of the animal. There have been cases that have occurred where the animal snaps and attack the human is usually in captivity. If some idiot goes walking in the Brazilian forests and get attacked by a jaguar that’s his fault. The elephant that attacks humans is usually the humans fault. Either the elephant is cooped up to long and snaps or the trainer did something that made them snap. They are wild and this is the risk. Usually the animals don’t want to hurt the trainers or keepers. This is the risk of having wild animals in shows and captivity. If you can take the risk that is fine but you must make sure all the pros are met and cons kept in mind. They are wonderful creatures and they want to please, but there is a limit.
